The Appeal was filed on May 12, 2008

A reminder from a past posting: Filing a brief is a time consuming process. We do not expect an answer from the court for 6 months to a year. There are many steps in the process.

- The Attorney General's office will be given time to file a response.
- Our attorneys wil then be given time to file a reply to their response.
- Then it will be in the hands of the court for a number of months.
- Whether oral arguments will be granted or not this time, we do not know.

At least now it is finally in process. Thanks always for your prayers and good wishes for Brandon's freedom. He's hanging in there and appreciates your support.

Our thoughts and sincere wishes are with Brandon and his family. Hopefully people will always keep the plight of these young men in mind when considering what kind of government we have and how we would like it to improve. A great way to be a good citizen is to stand up for a good cause like the release of Brandon by getting involved and making your opinion known to our government officials and to your friends. Tell them that a legitimate government must be willing to admit mistakes when they occur and rectify them in whatever way is possible.

Keep the faith Brandon!

How sad it was to read Brandon's story. I also have a son, in Florida, who is serving life in prison for being in the wrong place at the wrong time where his friend was murdered by an animal carrying a gun, unbeknownst to my son. Florida also has the felony murder rule which allowed my son to be charged with first degree murder. If you go to Google and put in Brian's name you can read about his case. His name is Brian Harvey, Jr. While I only have a MySpace page created for him at this time, also showing some of his artwork, I plan to do much more, such as create a website for him, when my funds allow it. Please feel free to go to MySpace and look for Justice4Brian. My heart goes out to your and your family. I am alone, a single parent and have no one that truly understands my grief. It was touching to read your story. Sadly, our attorney did not have a great defense and didn't represent Brian well and even more sadder, I am afraid the appeal process will take way too long and I may not see my son through his ordeal as my health is not well. I will keep you and your in my prayers and I wish you and Brandon all the best of luck in this sad, sad process we call the justice system.
