Status of Appeal 9/12/08
Hello Everyone,
We have another update for you on the status of the appeal. The Attorney General's office filed their revised brief and resubmitted it to the United States Court of Appeals for the Ninth Circuit on 8/21/08. Our attorneys requested an extension and will file their response on 9/19/08.
Our apologies for the delay in posting some of these updates. Sometimes it takes longer than we'd like in order to get time to work on the blog because of travel for work or other issues. Recently Gene took a spill on the stairs (aided by the cat who thought that was a good place for a nap) and dislocated and fractured his right ankle. Surgery and a cast have him mobile again. Now in order to visit Brandon, he needs a note from the doctor stating that the screws and a plate are supposed to be there. Instead of going through the metal detector he will need to have a wand run over that that area. This is still doable though and we are grateful his injury was not worse.
Brandon is doing all right. There is nothing new to report about his living conditions. He works, he reads, he listens to music, he exercises and focuses as much time as possible on his artwork. On a sad note, his grandfather recently passed away. They were close. These things happen when someone is in prison. Life and time moves on. With love for Jerry's memory we close for now. Thank you all for your kind and caring support.

I'm a junior at a high school in New Jersey and for the past week we have learning the details about Brandon's case in American Legal System Class...we finished today the movie 'Reckless Indifference' and i must confess that i am inflamed with frusteration and anger at the injustice that was done in that court room. I'm aspiring to enter into the criminal law field and now more than ever i want to strive to acheive my goal so i am one more person preventing unfair decisions happening in our system today..i wish to send, yes distant, yet strong condolences and sympathy to you, Brandon's family, and friends. I proudly signed the petition and am praying for the success of this final appeal.
Give my regards to Brandon, as him being someone who influenced me, some junior on the east coast to aspire even more so in preventing injustice in this "just" system that we have in place today.

Hello to who ever reads this,
We have recently learned about Brandon's case in high school in Kentucky, It's crazy how such an innocent man can have life without possible parole. I would like to have the opportunity to talk to the government and let them know how screwed up the system is, Brandon was clearly an innocent man.
I signed the petition and hoping that everyone's prayers are going to be answered and hopefully Brandon gets released soon!

I heard about Brandon's case several years ago through a woman who was at that time a member of Rotary -- she was related to you, although I forget the exact connection. She is no longer in Rotary and I haven't seen her in years. From time to time I think of the case and wonder how things are going. Thanks to the internet, I found this blog easily. I just want to let you know that you are in my thoughts and prayers. Brandon is blessed to have parents who stand by him.
